1. Welcome

These terms and conditions apply to:
  • Paua Wellness
  • Innersunrelaxation and
  • YogawithJudy / Yoga Therapy & Wellness with Judy and
  • You
The term Paua Wellness refers to all the above. Paua Wellness provides one to one individual and group sessions.

Please read these terms and conditions carefully before using our services. We do not provide services if you are under 18 or unless in a family group or your parent or guardian has contacted us and that they have read through and discussed with you these Terms and Conditions.

You accept these terms and conditions and consent to working with Paua Wellness when you complete an intake form and attend your first appointment. If you do not agree with any of these terms and conditions, please do not contact us for more information.

Once you register with Paua Wellness you will be bound by these Terms, and they will form a contract between you and us.

We ask you to take care of yourself, do not do anything that causes pain or harm to yourself. You are responsible for yourself.

If your doctor or a health care professional advises you not to participate in any of our programmes, it is your responsibility to acknowledge and carry out this advice.

Paua Wellness is not responsible for your health, physical and or emotional. We offer programmes that support medical care, the intake process is a way of assessing your safety to participate in Paua Wellness programmes.

Consent

Consent is assumed for each session. You do have the right to withdraw your consent at any time, if you wish to do so, please tell the practitioner. One-to-one individual sessions are designed with you for you, you have the right to refuse any suggestion, do tell us.

Chaperone

You are most welcome to have someone with you, such as your carer, interpreter, or sign/communication carer, please highlight this on your intake form and we will discuss this with you.

Positively promoting equality

Paua Wellness practices and is committed to equality and anti-discriminatory practice in line with human rights and anti-discrimination law including “protected characteristics”: age, disability, gender reassignment, marriage or civil partnership, race, religion and belief, sex and sexuality.

Threatening, abusive behaviour

Paua wellness will not tolerate abusive language, threatening or discriminatory behaviour online, telephone, web, face to face or in any form of communication, with Paua Wellness staff, subscribers or group members.

Persons exhibiting such behaviour will be asked to leave the premises immediately if in face-to-face settings, or to log out of online settings.

Paua Wellness reserve the right to place a bar such on persons and will report this behaviour to the police.

In this instance, no refunds will be given.

Privacy

Paua Wellness collect personal information from you in order to provide you with a service. We do not share any of your details with any third party. When placing a booking, or attending a class, session workshop or retreat you are obliged to provide us with your name, address, email address and phone number and a contact number of someone in the event of an emergency. The intake form asks for more information so that we can provide a safe service for you, but you are under no obligation to share anything you do not want to. You are responsible for yourself. Cookies

Confidentiality, data protection

Your personal data will be kept confidentially and only used for the purpose of Paua Wellness services. Data will not be kept for longer than is necessary. Data will be kept securely and in accordance with the legal principles set out in the General Data Protection Regulation 2016 and the Data Protection Act 2018 and GDPR 2016.

Your rights and your personal data; data protection

Unless subject to an exemption under the GDPR, you have certain rights with respect to your personal data as set out below.
  • The right to request a copy of your personal data which we hold about you.
  • The right to request that we correct any personal data if it is found to be inaccurate or out of date.
  • The right to request your personal data is erased where it is no longer necessary for us to retain such data.
  • The right to withdraw your consent to the processing of your data at any time. This right does not apply where we are processing information using a lawful purpose other than consent.
  • The right to request that we provide you with your personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), (where applicable). Paua Wellness data controllers are Jilly Parkinson and Judy Mace:

  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing.
  • The right to object to the processing of personal data, (where applicable) [This right only applies where processing is based on legitimate interests (or the performance of a task in the public interest/exercise of official authority); direct marketing and processing for the purposes of scientific/historical research and statistics].
  • The right to be informed if your data is lost. We shall also inform the Information Commissioner’s Office in accordance with the time limits in the GDPR.
  • The right to lodge a complaint with the Information Commissioner’s Office.

Disclosing information

In the unlikely event that we need to share your information will seek your consent to do so. We are however legally bound to share information if there is a risk to yourself or others in the “Public interest” which means those ‘exceptional circumstances that justify overruling the right of an individual to confidentiality to serve a broader societal interest and to safeguard vulnerable adults and children.

Safeguarding children, young people and adults at risk

Paua Wellness practitioners have appropriate Disclosure and Barring Service (DBS) checks. Disclosing confidential information may be necessary when in the public interest and under children and vulnerable adult safeguarding law.

Complaints

Paua Wellness aim to provide safe high-quality services. Paua Wellness is an evidenced/best practice-based service and provides services in good faith. There may be times when we do not have the right skill sets/ qualifications to safely work with you, when this is the case, we will discuss this with you and if we know of an appropriately qualified practitioner, we will direct you to them. Paua Wellness do recognise that some people may have a compliant about our service and we are keen to understand how we can improve based on your views.

  2. If your complaint remains unresolved do write to us formally, we promise to respond to you in writing within 14 days and complete any investigation and full response within 28 days.
  3. When you remain unhappy complain in writing to: British Wheel of Yoga – https://www.bwy.org.uk Complementary & Natural Healthcare Council www.cnhc.org.uk which regulates national standards and practitioners’ good character and fitness for work, or an appropriate statutory organisation.

Working with you online, connectivity, safety

  • Paua Wellness deliver all sessions from private spaces, where no conversation or activity can be seen or overheard by others.
  • Paua Wellness cannot be responsible for your safety, you need to make sure you are safe in the space you are in and what you do and say.
  • If connectivity “drops off”, be safe, come out of any posture/shape carefully and gently, do not rush. Reconnection will be made as soon as possible. If you lose connection, re-join the session as soon as possible.

Refunds and Cancellations

If Paua Wellness cancel this will only happen in exceptional circumstances where a Paua Wellness practitioner is unable to cover the session.

Your bank details will be required for a refund or another arrangement as agreed with the Paua Wellness practitioner.

If you cancel:

A yoga class – NO refunds
A one-to-one sessions, supervision and small groups – A strict 24-hour cancellation policy applies to all therapy appointments. If you cancel less than 24 hours before your appointment, or if you do not turn up for your appointment, you will be charged the full appointment fee. NOTE Small Groups will only run if there are at least 6 participants.
Workforce sessions –
Subscriptions – Cancellation do not renew. No refunds.

How Paua Wellness works

  • Contacting us, Paua Wellness will acknowledge your contact via an automated email.
  • For more information we will respond to you with in 14 days
  • Before sessions an intake form will be emailed or sent to you to complete; this must be completed and returned to us so that we can consider your needs.
  • By returning your intake form – you confirm that you agree to Paua Wellness terms and conditions including that all information is held in confidence and kept secured in a protected computerised system, as per the General Data Protection Regulation 2016 and the Data Protection Act 2018.
  • Payment to Paua Wellness (BACS Details will be sent to you)
  • On receipt of the intake form and payment -You will be sent a Zoom link / appointment details
  • One to one / individual first session is to talk through your intake form and what you to work on, we may try some activity, movement, or another approach during the first session for you to get a feel of what could be provided. The programme is designed with you.
  • One to one / individual bespoke programmes are up to 8 sessions, after which we review your progress and ongoing needs.
  • Small groups are with 6-8 people with similar needs to you, at the end of 8 sessions a review and next steps take place.
  • You may be given a “take home” handout to use in your everyday life at the end of programmes that are 8 sessions.
  • Ongoing larger groups offer more generic advice.
  • Courses are 6 -8 weeks duration and acceptance on the course is at the discretion of the tutor, on submission of your completed intake form.
The Intake form is confidential, only share what feels right for you to share. Paua Wellness will work at “face value” we aim to do no harm and can only work with the information that you choose to provide to us.
Paua Wellness is not a diagnostic and treatment service. It is a holistic approach which is designed with you for your self-care and can be used alongside any medical or other complementary treatments.
We reserve the right not to work with you or to continue to work with you, this may be under circumstances such as:
  • We do not have the appropriate skills to meet your needs.
  • If you are a danger to the therapist or others
  • When there is a discordant relationship between yourself and the therapist.

Please note this is not an exhaustive list.

Length of Paua Wellness sessions
  • Intake 1 to 1 ¼ hour
  • All other sessions are an hour, unless agreed otherwise.

Arriving on time – all sessions will start and end at the arranged time.

Payment

before the session/s, in blocks of weeks, to meet your need. After payment you will receive a Zoom link for the number of sessions that have been paid for.

Concessions can be arranged. Discuss your needs with us.

BACS details will be sent to you, on receipt of the intake form.

The Zoom link details will then be sent to you after payment had been received by Paua Wellness.

What to wear – eat/drink wear comfortable clothing that is easy to move in, to keep your body temperature as you need it to be.

Do not eat a heavy meal 2 hours before your session. Drink as normal and have a drink accessible available for you during the session.

Feedback to Paua Wellness

We may from time to time ask for your feedback, this may be in the form of an email, short questionnaire, testimonials or verbally. This is important to us to help improve our offers.

Taking photos / screenshots

We may ask your permission to take photographs, these will only be taken with your permission and only be used for Paua Wellness media.
These Terms were updated: July 2021 and will be reviewed July 2022, unless legislative changes determine earlier review.

We advise you to print or save and keep a copy of these Terms for your records.
